“Probate” is often the term for the court supervised process of administering a decedent's estate either by the terms of the will or if there is no will or trust, by the laws of intestacy. If a person dies “intestate” it means there is no will or trust, therefore the state will decide how and to whom the estate is distributed, which may not be what your loved one would have wanted.

It requires the filing of a petition, which is the request to the court to appoint a personal representative (whether executor or administrator) to take charge of the estate, gather the estate assets, pay the estate's creditors and then distribute the remaining estate assets to the heirs or beneficiaries. This is a public process dictated by statutory timelines and notice requirements. The attorney fee for representing the personal representative is also dictated by statutory guidelines, which are ultimately subject to the court's final approval.
